Information and its use
Information used includes visitor technical data, such as IP addresses, browser details and pages accessed; correspondence and contact details; subscriber and engagement information; and names, roles, quotations and case information from public judgments, articles and online discussions. Publication sources are identified where available and may contain sensitive or criminal-offence information.
Legitimate interests support website operation, security and performance, legal research and publication, teaching, practice promotion and handling enquiries. Newsletter emails rely on consent where required. Information is also processed to meet legal obligations.
Additional provisions for sensitive or criminal-offence information include the publication-of-judgments condition in Schedule 1, paragraph 26 of the Data Protection Act 2018, where applicable. Journalistic, academic or literary publication exemptions apply.
AI use
Matthew uses and evaluates a wide range of available AI services, including ChatGPT, Claude, Gemini and emerging or experimental tools, for research, analysis and editorial assistance.
Confidential client information and private correspondence are not supplied to AI services. Only publicly available judgments, articles and online discussions are referenced.
Newsletter and Substack
Newsletter subscriptions are managed through Substack. If you subscribe, your email address, any name you provide and subscription preferences are used to deliver and manage the updates you request. You can unsubscribe at any time using the link in each email.
Matthew is the controller for his subscriber list and newsletter communications. Substack processes information on his behalf and also as a controller for its own platform purposes.

Services and sharing
The site uses WordPress.com/Automattic for hosting, security and performance services, and Cloudflare Web Analytics for cookie-free usage statistics. For other platform or embedded features please see relevant provider’s privacy information.
Information may be processed by providers of cloud document storage, email, AI research tools and newsletter services, and shared with Chambers, professional advisers, insurers, regulators or authorities where necessary. Published material is accessible worldwide.
Service providers may process information outside the UK, including in the United States. Their published transfer arrangements include UK adequacy mechanisms and contractual safeguards, such as the UK Addendum. Information about relevant recipients, transfer arrangements and copies of applicable safeguards can be requested through Matthew’s clerks.
Retention
Research and publication records are retained while needed for continuing reference, verification, corrections or legal requirements. Correspondence is retained for handling the matter and relevant practice record-keeping. Subscriber information is retained while subscribed, with limited records afterwards to honour preferences or record consent.
AI conversations are deleted when no longer needed for the task; providers may retain copies under their own rules. Hosting logs, security records and backups follow service retention arrangements. Automattic generally retains visitor web-server logs for approximately 30 days.
Your rights
Depending on the processing and applicable law, you may request access, correction, erasure, restriction or portability of your information. You can withdraw consent, including by unsubscribing from newsletter emails, without affecting earlier lawful processing.
You may object to legitimate-interest processing on grounds relating to your situation, and to direct marketing at any time.
Contact Matthew’s clerks to exercise your rights or raise a concern. You may also complain to the Information Commissioner’s Office.
